Definitions
Bestkaraoké.fr is primarily a platform site for downloading instrumental tracks or backing tracks.
Downloading is understood as the transfer of a digital file from our server to a personal computer.
The offer The selling price for the karaoke tunes are in Euros and include VAT. Bestkaraoké reserves the right to change them at any time.. Payment can be made by PayPal or credit card. Karaoke files purchased will be paid for before they are downloaded. The karaoke files are sold without any lyrics and act as Mp3-format instrumental tracks. Confirmation After you have created the required account, conformation of your purchase constitutes final acceptance of your order and of our Terms and Conditions of Sale. The accounting information and data kept by BestKaraoké constitute proof of the transactions and purchases made by customers of BestKaraoké.
Order fulfilment The order will be filled immediately if the file or files are available on the download server.
If the product ordered remains unavailable for more than 10 days, Bestkaraoké undertakes to inform the customer of this as soon as possible and to state when the product will be available.
The customer will confirm by e-mail his/her decision either to wait for the product to become available or to receive a refund.
With regard to the “customised backing tracks” section, your order will be approved after we receive your payment; the product will be delivered within the period of time indicated in the initial estimate.
Force majeure In addition to those customarily considered as such by jurisprudence and the French courts, the following will be expressly considered to be cases of force majeure:
- Complete or partial strikes, internal or external to the company, blockades of means or transport or supply for any reason whatsoever, governmental or legal restrictions, computer crashes, blocked telecommunications including networks and especially the Internet.
The occurrence of a case of force majeure will initially suspend execution of the order by right.
If the parties find that the case of force majeure persists after three (3) months, the order will be automatically cancelled unless otherwise agreed by both parties.
Right of return or refund Generally speaking, no refunds are given for purchases made on our site; they are firm and final.
We assure you that the products made available for download correspond exactly to the products ordered.
However, in the event that the download does not function correctly or the product does not correspond to your order, you have 45 days from receipt of your order acknowledgement to request a standard exchange (damages files will be exchanged for the same titles).
Limitation of liability Bestkaraoké declines all liability to you or to third parties in the event of indirect, special, accidental, prohibitive, coverage or accessory damages, (including but not limited to damages for the inability to use equipment or access data, operating losses, lost profits, interruption of business, etc.),, associated with the use or impossibility of using the service.
Bestkaraoké may not be held liable for the fraudulent use of your login ID and passwords and will not be required to refund purchases made on the occasion of such use.
Disputes
We recommend that you first send us any complaint in writing to the address below. We will try to the extent possible to give you satisfaction based on the validity of your request.
In any case, any dispute will be handled under French law.
In the case of a payment dispute, noncompliance with these terms and conditions or any attempt at improper use of our products, Bestkaraoke reserves the right simply to cancel an account.
